To be accurate the question should ultimately be:
If there was no [party that supports unconstitutional policies], would we have [individuals who support unconstitutional policies]?
Your question presumes that to be a [genuine] member of the Republican party automatically means that you support no unconstitutional policies.
The party system is a dangerous way to look at American politics. We should retrain ourselves to look at policies themselves and compare them to the Constitution. The party system is precisely how things got so out of hand to begin with
