Wouldn't there have to be a court decision on the auto pen? Otherwise, doj is constrained by the pardon.

The autopen is an example of what an illegitimate (p)resident and administration tried to do.

Illegitimate (p)residents can't issue legitimate pardons.

When the Buydan illegitimacy is proved, the pardons become illegitimate (null and void) as well.
