how could they argue he can't be impeached because he's out of office - if he was secretly maintaining office ?

If I read this with a Q mind. I see the "President" in quotes. So yes as they are arguing Trump is not longer “President" of the United States.

Maybe he is President of our new country.

Biden is in some capacity president of something. What that is is just not clear yet.
