This is a court case for military tribunal. It’s not applicable to executive orders. The original document for the court ruling has nothing about “emergency” or “section 98” with just a quick ctrlF.

Plus, stop posting screenshots when you can go find the original and verify yourself.

From what I've learned, Milligan (1866) is a highly relevant case, and used all the time in common law.
