First, you're almost always guilty until proven innocent. The onus, or burden of proof rests with the accused proving innocence, NOT the prosecution proving guilt. And if he elects for a Court Martial and not "office hours" with his commanding General, then his jury will be made up of his peers. MILITARY peers who ALSO know what the UCMJ and Navy/Marine Corps rules say about speaking out publicly against your sitting leadership.
Besides, the "official" narrative and stance on Scheller is one of betrayal against a sitting Generalship and President. As long as that remains the case, Scheller will be punished, and Milley will walk free. Why? Because Milley is backed by the rest of the JCS, SecDef, and POTUS.
LtCol Scheller's impending trial JAG won't EVER allow the type of "evidence" you propose. Military Court is FAR different than Civilian Courts. As Uniformed Members, our place isn't to publicly criticize, even if we "know" we're right. And he did it AFTER the fact. It can be debated rigorously by both sides that what Buyden did was directly harmful to fellow members. This will be a USMC trial, if it goes that far. The prosecution will argue that it didn't affect The Corps, so his words were out of line. They'll also argue that he was out of line as a Marine Commander, because if ANY Marine has issues with orders or what they're witnessing within the Chain of Command, they SHALL argue it within the CoC, thru the IG's office. And he didn't do that. He admitted that much. Doesn't matter that he "knew" his words would fall on deaf ears. He didn't even try. That's the angle the USMC and DOD is arguing here. And they're 100% correct. Scheller knew it when he made that video. And now he will pay the price.
Because there's absolutely one thing the military CAN'T have, and that's mutiny. LtCol Scheller will be made and example of what not to do for the next few generations of Marines.
I don't agree with it, but he DID violate the UCMJ and the USMC's regulations on speaking out against bad leadership. I commend him for his bravery throughout his career, and I eapecially commend him for his bravery here, however misguided and emotional it was.
