but is the federal employee thing constitutional?
Religious exemptions cover this and include strongly held belief or conscience.

On Tuesday, Southwest’s CEO announced that “we are not going to fire any employees” over the company’s vaccine mandate, and pointed to the Biden policy as the reason for the mandate’s issuance. However, the Southwest Pilots Association on Friday filed a lawsuit against Southwest ahead of a weekend of massive operational disruption; the lawsuit was filed in U.S. District Court in Dallas, Texas.
OSHA just sent their rule language to the OMB and White House for approval.
Mmm hmm. So nothing has been legally finalized therefore no mandate exists...
Federal mandate exists. It was just slapped on me by my workplace. It effects federal workers and all those who contract with the government, which is being interpreted as broadly as possible and so is huge. The general workplace with >100 people is coming, OSHA has not officially published it yet. Probably before the fed mandate goes into effect (Dec 8) I'd say. Watch for a wave of firings to get some companies under 100 people. Others will have people quit and will then fall under 100. But many will be forced because they want to eat and pay their rent/mortgage, like me.
But is it Constitutional?
None of this is constitutional.
Nope. But neither was the Patriot Act. Or Obamacare. Or dozens of other travesties since then. 👍🏻
Correct, but it will soon exist. Soon businesses will forced into this policy, or fined into oblivion by OSHA. I'll be surprised if it's not approved by the end of the week.
Also, anyone that understands how OSHA works within civil law, will know that all it will take is for a few pro-vax employees to file OSHA complaints, and it will set the companies up for huge lawsuits. Lawsuits cost a minimum of $100k just to settle, and usually 2-3x that just to go to trial and defend (not including the judgement). Even winning a civil lawsuit costs an employer $250k.
The choice will soon be comply, or go out of business.
The tide is pushing against this... Help drive the tide.
I’m a large employer (way over 100) and I’m pushing back as much as possible.
This is like being caught between a rock and a hard place for businesses and employees.
And that’s exactly what the Commies want in order to get the number of vaxxed up and crash the economy for their great re-set).
Hope the white hats step in soon.
Have you thought of restructuring into total employment/90 employees? It is also a great way to train people for more responsibility. They get a better title and run a small corp that can be grown. You will get better input and a deeper bench.
We have over 600 in several states. That’s not a really an option for a number of reasons, but I appreciate the thought.
Once the official guidance/ruling is released, we’ll look for ways to minimize the damage.
We’re working on sourcing test kits for our employees at our expense.
Well you know your firm, and who you have spoken with about it... But there are structures that you can create where a separate ( or several based on geography, task, skills) company supplies the employees to the management (operations) company and another manages the assets (Plants, Property and Equipment).. You wind up with a number of op cos...
