No chance, if it’s retroactive then Trump would be able to keep his privilege. I have a feeling this has been the plan all along. They knew (we) couldn’t get around the executive privilege to expose Obama, so we tricked them into opening the door.
Wait, the trick was to stage Jan 6 knowing it would upset Congress enough to launch an investigation, then they would request all the files from Trump. Trump would deny and fight them tooth and nail for 6 months until it went to a federal court where they said no, they can see the records. Then ... someone ... is going to use the very specific court ruling that said a former President can only claim executive privilege if the current President agrees with them to unseal Obama's records, which won't be able to be released because Biden is president and he will just say, No, he has executive privilege.
That's the trap that was set? What if the judge who said the files could be unsealed voted they couldn't? What if the Jan 6 committee was never formed, which it almost wasn't. What if Biden would've upheld executive privilege knowing one day he'd be exposed?
But who is requesting the records of Obama, Bush, and Clinton? There is no committee asking for them? And if there is, the way the ruling is written Biden can just say it's executive privilege.
Do you think they will say it won't be retroactive to obummer's time in office?
For example, full document release is only effective in 2021 and going forward.

I hope that is the case because I haven't smiled this much in forever after reading this.
Don't we love it when you see that "I've been whut?" reaction in people. Hahaha.

yeah exactly. We will have to see how it plays out
I think you are missing the important part of this decision:
Biden's claim that “assertion of executive privilege is not in the best interest of the United States.”
They will claim that assertion of executive privilege IS in the best interests of the United States in the cases of Obama, Bush, Clinton.
But who is requesting the records of Obama, Bush, and Clinton? There is no committee asking for them? And if there is, the way the ruling is written Biden can just say it's executive privilege.
yes exactly
We can hope, we can hope only hope.
