Yes, but its still a matter of jurisdiction. It means the Federal OSHA doesn't actually have jurisdiction, even if the states are following what the Federal says. I.e. the states have the jurisdiction, and the Federal is guiding them, meaning there is no legal path between them, only a guidance.
This means its not a Federal issue at all, but a state one.
I actually agree with you and governor DeSantis sees this as a way to stop the federal 'weaponization' of OSHA. This is why FL is moving to create their own Stat OSHA. What's sad is that the other States that have State OSHA act like a rubber stamp to the Federal OSHA.
Agreed. In case you didn't see this, I posted the following:
I thought @MAG768720 did a great job digging the authority for the OSHA ETS for the 'COVID' guideline. It appears OSHA does not cite any authority over private sector corporate entities.
The entire "vaccine mandates" are directed only to government employees and/or contractors. Is this constitutional? Well, injecting drugs for a fraudulent reason is not, but otherwise these provisions are with the fed's authority (OSHA, overall) -- PROVIDED they ONLY apply to federal operations.
You're right, except the State OSHA's are typically parenting the federal OSHA and are to be in accordance to the federal OSHA.

I think the Federal OSHA only has jurisdiction over Federal employees, Washington D.C. and maybe the territories (Puerto Rico e.g.).
