@KanekoaTheGreat
I read the lawsuit.
The case is VERY well documented.
I don't believe she will be awarded $2 Billion, but certainly $500 Million would be a reasonable jury award.
This lawsuit may also result in criminal cases against some of the people involved.
The problem I see here with this case is the same problem that has plagued many well documented complaints - standing. The plaintiff cannot represent the country as a whole nor any specific governmental office who's job it is to conduct oversight. I also cannot find anywhere in the filing damages that this plaintiff is claiming to have suffered from directly due to the actions of the defendants that would lead to asking the court for relief. Therefore, I don't believe that this case itself will go anywhere - but the information could be used as part of other actions that do have standing.
Standing really is bullshit though. If ever we have to fully reset the country, that needs to be knocked the fuck out of our justice system.
You are most correct. Standing has been used as an excuse to weasel out of hearing controversial cases on their merits. Attached to this case is some excellent research and documentation. But unless I missed it somewhere, I cannot find a cause of action. The plaintiff from what I can tell has not claimed to be damaged in any way by the actions of the defendants for which relief can be sought from the court. If they could find other plaintiffs that did suffer damages directly from the defendants and add them to the lawsuit as a class action, then that would give the case standing. But as it looks now, I do not see any reason why a court would not dismiss outright.
I just find it so weird that we can provide proof of crime out the ass, show them the crimes directly and that the crimes were premeditated, but standing alone prevents that crime from being prosecuted.
Such a broken system.
I curious to how you made that assessment. Can you elaborate?
If the civil suit shows they are guilty of falsifying records, a prosecutor will typically file criminal charges after the civil suit.
