Since Ukraine is not a NATO nation, then this is a hostile incursion into a combat zone by NATO forces. Hard to argue they are non combatant advisors in non-combat roles when they are in a combat zone - Mariupol. Russia already said they do not have to treat any foreign fighters as POWs by law, and plan to treat them all as soldiers of fortune.

Literally, if he were not there, against orders, that would make him a traitor and he would face a court martial, but now he faces being tortured or mistreated for doing his duty.
