The lawsuit names the City of Columbus, Fihe and Winchell as defendants and argues this is part of a pattern of misconduct by Columbus police and a lack of investigation into officers' behavior, calling it "unconstitutional policing."
UNCONSTITUTIONAL POLICING
Everything about what he (ATF agent) was doing was unconstitutional as fuck
Try getting a jury to side with the Fed though. They won't have it so easy. The full video is more revealing. The Fed was attempting to get in without a warrant and scared this immigrant woman and her kids. Why was he there to see their gun in the first place?
He deserved to be cut down to size by the locals. What an attitude. Thinking he didn't have to comply with police, and whining like a little baby about it. I guess that is the type who would think he could take somebody's gun without a warrant.
That's not true. The woman tells the cop that he knocked on her door. Somehow the 911 operator, who was given the agent's full name and badge number/ID over the phone and this woman's testimony that he knocked and told her he was there to retrieve the illegally possessed weapon got turned into a fake LEO + home invasion. He never attempted to get into the house.
He didn't comply with police so they could determine that for sure. Also, I wouldn't be surprised if there was some taking out animosity towards the Fed, especially after he gave them attitude. Feds need to stop going after people's arms. If they are not committing crimes with them, then leave them alone.
The question that should be investigated then is why the dealer then sold it to him. I don't think you are supposed to letterman have it until the results of the BG check come in.
Apparently if X amount of days (3?) go by and the background check hasn't come back saying no, the sale is permitted to go through. Then, in cases like this, when it does come back after the sale as a no, the ATF get notification and they go and retrieve the firearm.
I believe in this case he is there to notify that the husband in fact failed, and that now he is illegally holding the firearm if he doesn't give it to the ATF agent. It appears to be a 'easy way or the hard way' where the hard way is if the husband won't turn it over, he gets a warrant and then he and other armed agents/police perform the search warrant and retrieve it.
The couple are not native English speakers, and my guess is the confusion between what the wife thinks is happening, and relays to 911 and what the 911 operator relayed to the police were way different (called in as a fake LEO with a gun trying to force entry).
When the cop goes back to the lady and asks here what is going on, she tells him that he only knocked on the door and stated she/they needed to turn over the gun. I don't blame her as she doesn't believe he is a real law enforcement agent (or just doesn't want to turn it over) and calls 911. He did in fact give his full name and ID/badge number to the 911 operator for her to verify that he is who he said he was - and none of that makes it to the responding officers.
This is how it should be handled, besides the fact they have no right to be there in the first place. No one should assume they actually are with a federal agency. That gets people killed.
Those cops deserve a raise. They handled that just right if dude woulda just laid the fuck down and had them pull out his ID it woulda been fine. No problems. Over in 20 second. That whole happening is on that stupid agent.
This is profoundly hilarious. When he says, "I can't breathe," I nearly fell off my chair. I really didn't know Biden era federal agents were stupid and wimps. Until now.
The husband bought a shotgun and the background check took too long so he was allowed to complete the purchase and take it home. Then, after that time, the FBI check came back that the husband was not allowed to own the gun, and as what happens in these cases, the ATF is notified to go and retrieve the firearm.
The wife isn't sure about this plain clothes law enforcement individual, and calls 911. He speaks through the door to her and gives her his name and badge/ID to the 911 operator who was supposed to verify for the wife. Instead, the operator sends out a call that a man who is posing as a LEO is trying to force entry into the house. Chaos ensues.
At no point was the ATF agent breaking any laws, even if he was a regular joe. Just remember that when someone calls the police on you for legally carrying your gun and you get scared-to-death officers pointing weapons at you from the jump - screaming at you to get on the ground like a dog. We should all be careful about how we cheer on police misconduct and abuse of power to salve their fragile egos.
The officers knew exactly who the guy was, trust me.
They roughed him us according to procedure because they can, knowing that following their procedure to the letter a roughly as they can will protect them, all to send a clear message to the feds about spooking around their jurisdiction.
I know there are lot of reasons to not like cops, but local cops are just as jackbooted by the tyrannical feds as the rest of us. And they despise them even more so than we do since they get a front row seat to the massive amounts of tyrannical abuse the feds commit on a daily basis.
Never forget Waco TX is what the feds think of you, and how they will deal with you. And no Waco wasn't a situation gone out of control. The plan from the very start was to KILL every last person in that compound without mercy so they could intimated anybody else thinking of resisting them. Thing was their plan to get away with it was they were going to do it SO BIG, so aggressive, so insanely that nobody would believe that was how it actually happened, what with firebombs, tanks, and machine gun fire in a frontal assault and then following up with chaning the doors shut and lighting the compound on fire.
I mean in the 1990's would have believed the FBI went harder than the KGB in killing their own people?
And then they missed the reporter team with long range telephoto lenses that recorded it all.
The feds are your ENEMY. They want you licking the boots, or dead. Cops know this.
Cop an't our friend either, but enemy of my enemy is enemy of my enemy and I will cheer them all all day as they fight each other.
The officers only knew what they were told. In your words someone was impersonating an officer and trying to force their way into the home. They had an OBLIGATION to secure the individual and ascertain the truth.
When they got there, the ATF prick could have cooperated and not act like a pompous ass. From everything I see, he made all the choices that lead to that outcome.
That moron cop got out of the car and immediately drew his weapon on a guy holding paperwork. Screamed 3 different commands at him in less than 2 seconds - 'hands up' / 'show me your ID' / 'get on the ground'. Which one should he have complied with?
This is totally an issue between the 911 operator and the police. There is no law that says you or I have to get on the ground. When the agent told him for the millionth time that he was a federal agent (a felony if he was lying), and the stupid cop yelled again for him to get on the ground, the agent stated 'I'm not getting on the ground' and the stupid cop says 'That's fine - why didn't you ID yourself?'
How could he have ID'd himself when every time the cop yelled for him to ID he also yelled don't reach (for his ID). Then after tasing him and arresting him even though he was lawfully conducting himself, the stupid cop says 'he wouldn't ID himself' which was 100% wrong.
Stop being a boot-licker and remember that these tactics that you applaud will only be applied more and more to the rest of us because it will be considered 'good policing'.
Well that made my day
Bravo, local LEOs.

Holy shit, look at this bit
UNCONSTITUTIONAL POLICING
Everything about what he (ATF agent) was doing was unconstitutional as fuck
I saw that. The article is very biased toward the ATF, did you notice that?
Yep, noticed that bit as well
Try getting a jury to side with the Fed though. They won't have it so easy. The full video is more revealing. The Fed was attempting to get in without a warrant and scared this immigrant woman and her kids. Why was he there to see their gun in the first place?
You missed another key detail, he was there to take a gun from them. Not just look
He deserved to be cut down to size by the locals. What an attitude. Thinking he didn't have to comply with police, and whining like a little baby about it. I guess that is the type who would think he could take somebody's gun without a warrant.

The husband failed his FBI background check - he was not legally allowed to own a firearm.
The question that should be investigated then is why the dealer then sold it to him. I don't think you are supposed to letterman have it until the results of the BG check come in.

Doesn't that fall under the rule of no matter what,do what the officer tells you to do? We have to follow that rule.

I have no clue why this is so funny. Kinda scary if you ask me.
I'm not a humor expert, but I know what I like....
Pigs being pigs. Just because they roughed up a Fedpig doesn't make it cool.
That’s exactly what makes it cool. Pigs getting a taste of their own medicine.
