The Government also plans to introduce evidence which reflects that every phone call received by the defendant from July 21, 2016 through August 2016 on the phone number that he provided to Sergei Millian was from individuals other than Millian who were known to the defendant (either from his contacts list or through other means), and thus, the defendant’s contention about an “anonymous caller” is not supported by the evidence.

But as discussed above, the defendant did not provide the FBI with the two additional emails that he sent to Millian , including an August 18, 2016 email which made clear that Danchenko had not, in fact, heard back from him by that date – thus making a late July phone call and planned meeting in New York an impossibility.

The problem with evidence like this is summed up in the statement “provided with these facts, a jury can reasonably conclude…”.

Society has gotten so polarized that a juror could easily conclude whatever they want. I watched the entire Sussman trial. It wasn’t even close, he was guilty but a DC Jury saw it differently. The Woke give the guilty a pass unless they are the victim and than all hell breaks out
