So among the standard 1st degree murder types, New Mexico is the only state I have ever seen making “depraved heart murder” a first degree capital offense. Not a lot of states even have this law. It goes back to the common law and is essentially a form of extremely reckless and egregious homicide.
California has it, and the link above is a good brief intro. People v. Knoller was a pretty big case in California about this. Those moron defendants did a lot of press conferences. I think there is even a made for TV movie about it.
Shooting your rifle in the air on New Years and then wherever the bullet came down it killed someone, if your state has this statute you will be charged with depraved heart murder.
To me, in the aggregate, all of these “reckless” examples rise to a depraved level. He should be charged with 1st degree depraved heart murder imo.

Did you read the just released Statement of Probable Cause. This guy is a idiot, extremely careless to the point of willful negligence both in handling the firearm, and in his responsibilities as Producer of the film.
