That is just silly. You are discriminating on a chacteristic that no other prisoner - or anyone else for that matter - will ever be able to detect without a medical, genetic examination of some sort.
They could be woman-shaped, have vaginas, breasts, no visible Adam's apple and you think they should go to men's prisons. Really? What do you think would happen? How would you justify that? Isn't that why we have separate men's and women's prisons in the first place?
So, which prison would you recommend for these people? Would it help if I told you they all have XY chromosomes?
