And property tax.
Complete BS they can take your free and clear house for unpaid taxes.
Agree 100%! Because of property taxes, you NEVER really own your home.
Property tax is a voluntary tax if you are a private party owner, property tax is supposed to only apply to corporations. I can prove this beyond any shadow of doubt.
Look up your states General Revenus Act, In California it called 1857 as amended 1859 general revenue act, This is the act that created property tax, for corporations, then you can go to the board of equalization for California on one of the first pages it states they derive their authority from said act.
question why would the California state legislature create an act to make it lawful to record a fictitious deed? California Civil Code Section 2952
Is the whole reason and purpose to record a deed is to show the whole world you own that property?
There is no law that requires a private property owner to record a deed.
The real reason was to allow you to volunteer in to pay Property tax.
The reason is because they removed the Acceptance and Acknowledgement paragraph from a lawful deed, the A & A paragraph, there are two forms of this paragraph, one shows that a private party purchased the property the other a corporation.
So how do the County Recorder determine by operation of law whether or not the land is required to be taxed and send the info to the tax assessor and collector? create a parcel number and or appraisal number Is by Operation of law.
Your fiduciary trustee failed in their duty to create a proper deed on your behalf, Put your name in all caps in the upper left and conner of the deed and left off the A&A and pur the new colorable land description on the Deed, Thus the Fictious deed... They also gave you a form and told you if you filled out this form they would reduce the filing fees...
This form is a voluntary transfer of the Tax Account from the last commercial land owner to the new commercial land owner, which again by operation of law requires the County Recorder to forward the account to the assessor office and tax collectors office...
how do you correct the record... study, get your states General Revenue act, I've looked at several states they are almost verbatim. You will have to record a new Proper deed. With your given name upper left corner and add the proper A&A paragraph and the original land description. will no longer have a appraisal number because they, the county will have nothing to appraise. I've studied this issue for years.
I found an old California law book called Kerr's California code. it has a section in it that stated, Property tax in relation to private property is not constitutional then listed the afore mentioned act! and a court case. I could go on but hopefully this gives a starting point.
PS, The California 1857 as amended 1859 general revenue act even says on the side notes that property tax it only applicable to corporations.! I could add much more history this topic however its a bit hard on forums...
Great info thank you so much!
All taxation is theft, honestly.
Property tax I think is probably the biggest offender as it is based on your home value INCLUDING improvements that you paid for and were taxed on.
Maybe it goes under income tax since income tax technically affects everyone and property tax only affects home owners, but damn.
I concur. In my state, MD, the property tax keeps going up and up, it never stays the same or goes down (not even slightly to the down side). I complain and complain. I am told it is the county's fault, I call the county and they blame the State, how nice of both of them. Meanwhile citizens get no satisfactioin.
In PA, you pay property taxes in the spring to the County and the Township. In the summer, you get a second property tax bill for the school. (the biggest of the property taxes is for school).
Yes, my in laws lived in PA, they had a lot money to pay into the school tax, then my father-in-law got a medical disability retirement and his taxes stopped altogether--which was really nice for them.
the millage rate for school taxes comes from the superintendent and school board. and it's very high in PA in my opinion. I used to work at the assessment office and people threaten our lives because of property taxes. little do people know or understand, the assessment office only assess the property value, it's the township, county and schools that set the millage rates that create that actual tax amount.
