Wait, what indictment was this? Does that remove an indictment? I'm lost.
I believe Jack Smith had grand juries for the Mar A Lago classified documents case in both DC and Florida. The case can only be held in one jurisdiction and not both. Judge Cannon called Smith out on this. So I assume the document case will proceed in FL not DC.
Having said that, the article highlights all the DC BS that was conducted with Smith had has grand jury going up there. Sounds like Judge Beryl Howell is a real winner. /s
No, the charges aren’t going anywhere until trial. This motion made Jack find a new panel or jurors on the Grand Jury, not from DC like originally but from Miami
This almost assuredly will not impact an existing indictment.
I would recommend looking at the court filing from the special counsel. The ending of the the DC jury is just a tiny bit of it. And I don't think Gateway Pundit is reporting the big parts of this court filing.
The superseding indictment I'll go through a timeline of this, but the end result was that Trump got hit with new charges in a superseding indictment.
The Timeline in DC and FL (roughly) The Mar a Lago case begins in DC and the investigation began in DC and the first grand jury was in DC.
Jan 2021 Trump leaves White House. Boxes are packed up.
2021 Presidential Records go to NARA, but they notice some are missing.
May 2021 NARA asks Trump to turn over any presidential records he has. This is the first request.
2021 There's several back and forths with NARA and Trump.
Dec 2021 Trump's lawyers say they found some more and return 12 boxes of records.
Jan 2022 15 more boxes are returned
Feb 2022 NARA makes a criminal rereferral to DOJ.
So now DOJ is involved and by the end of April a grand jury investigation has started.
The DOJ also gets the security camera footage from Mar a Lago.
By August a search warrant is obtained and the search occurs. The search warrant is approved by FL judge.
The TWO grand juries
So the investigation began in DC, witnesses were interviewed in DC, but the DOJ found the charges in play basically took place in Florida with some small exceptions. The documents were retained in FL.
This means that the special counsel had the take the evidence in developed in DC and present it to a new grand jury in Florida because the DOJ is alledging crimes taking place in Florida. The FL grand jury agreed and returned an indictment.
This recent document was about how the superseding indictment came about. In the recent court filing, the DOJ got the superseding indictment because they were looking into crimes in DC, specifically witnesses lying to the grand jury in DC.
This is the takeaway others are reporting. That a Mar a Lago employee who was going to be indicted for perjury got a new lawyer, retracted his false testimony and is now a cooperating witness.
This Mar a Lago employee was originally represented by the same lawyer who is represented the Walt Nauta who is indicted.
The bulk of yesterday filing lays the case the the DC grand jury was appropriate - the testimony took place there- and again asking the judge to look into the conflict of interest this lawyer is now in.
The DOJ is asking for a GARCIA hearing, that is to determine if Nauta's lawyer has a conflict
The DOJ is saying Walt Nauta's lawyer might have to cross-examine his old client "Trump employee 4" as he testifies and legal precdent says this is "actual conflict of interest."
So yesterday we learned Trump Employee number 4 is a witness who testified about destruction of evidence. And his old lawyer is still involved in the case and might have a conflict.
Oh and the DC grand jury that delivered the superseding indictment is closed.
