It’s gonna fall on the Supreme Court to uphold, since this is directly against the 14th Amendment Section 1 / Citizenship Clause.

There is no birthright citizenship in the 14th.

The phrase you're looking for is 'subject to the jurisdiction of'.

An illegal is not subject to the jurisdiction of the US but to their country of origin to which they are a citizen.

American Indians were not US citizens until 1924, despite being born in the US.
