The problem with that is they give up their Senate majority because Harris is the tie breaking vote and her VP pick would need Republican approval from the House and Senate.

Maybe they'll assert she can hold both offices simultaneously until a new Veep is appointed. By the time any lawsuits work their way through the courts the election will be over and it will be moot.
Once VP is chosen he/she has to be voted on.
