Lawsuits that violated civil rights need to start holding the individuals that violated the rights more accountable (financially). A “town” doesn’t make decisions, people do. Just think, if you sue your town and are awarded financial damages, you’re paying your own judgement.
I foresee the video tape of that incident will magically disappear from the city's servers. Oops, sorry judge but there is no evidence of wrong doing by the mayor.
I'm going to offer a different view. Although I completely disagree with an arrest here, I would argue this is not a first amendment issue. She was in a controlled setting with rules. The forum was setup to bring up city and council issues and specifically not to complain about a particular person. She not only used the forum to bring up a particular person but she also brought up that persons salary. This was not a first amendment issue and they have every right to state what the forum is for and to have her removed for not sticking to it. This is not violating any first amendment right at all. Again, I don't agree with the arrest and man the Mayor really gives me the eeby-jeebies, sure, but her first amendment rights were not violated here. There is a logical distinction between barring someone from saying something in a completely public and open forum (like a literal soap-box on the street) and a forum "open to the public". The council and mayer did not at any time request she be arrested - they asked for her to be removed because she wasn't adhering to the laid out rules. She was arrested for her behavior in leaving - which we can all agree is BS. I have seen a number of these where its not the same, someone is completely discussing policy or "the city" and they go for kicking them out - this, although abhorrent also isn't a first amendment issue whether you agree with it or not. Ok, different view offered - don't hate me, but I feel this would be an easy thing to defend for the city there.
If they never set up a place for citizens to voice their concerns or if they always make rules that prevent the voicing of grievance then your response is invalid. They work for us and they don't make the rules. Remember this pede
