I'd rather have a good Constitutional Republic where we follow laws, than such a totalitarian dystopia where military tribunals can supersede civilian law, for civilians, in peacetime.
One guess would be being declared enemy combatants. Maybe there are civilian courts prosecuting cases. They could operate the courts in a US territory or something. I'm guessing, as I said. If it's a district where they committed or passed through to commit crimes, they could be tried in those districts, I would think.
