The MOST IMPORTANT takeaway - for me - from today’s SCOTUS decision on the Trump Tariffs has nothing to do with trade - it’s about precedent.
During oral argument - Justice Gorsuch asked the administration’s lawyer an extremely important question.
He cornered the administration and simply asked: If the Court upholds these tariffs, can a future President unilaterally declare a “CLIMATE EMERGENCY” to bypass Congress and impose their own agenda?
The administration’s lawyer was forced to reluctantly agree and say, “yes.”
Now, as scary as it might be - just for a very brief moment - imagine President @AOC or @GavinNewsom or a President @maura_healey. 🤔
What looks like a defeat today might actually be the firewall that saves tomorrow.
When President Trump provokes and cajoles SCOTUS in advance of a ruling the way he did on IEEPA tariffs, he’s knew they are going to rule against him. But, he does nothing random, there is always a target.

maybe this case was about outmaneuvering SCOTUS. Maybe IEEPA was used knowing that in the process of blocking it SCOTUS would have to endorse other laws that give broad authority to levy tariffs?
I honestly believe that POTUS was doing two things: exposing compromised SCOTUS seats?, exposing other avenues to explore for future situations in tariff compliance? Justice K in his dissent, gave a clear indicator of potential methods to employ for expected results.
President Trump: I am allowed to cut off any and all trade for business with that same country. In other words, I can destroy the trade, I can destroy the country, I'm even allowed to impose a foreign country destroying embargo. I can embargo. I can do anything I want, but I can't charge one dollar.
