However, the defendant has the right to choose jury sentencing (also called the punishment phase to the jury). This choice is usually made before the trial begins.
When the defendant elects jury sentencing, the same jury that decides guilt then hears additional evidence about punishment and sets the sentence within the legal range allowed by law.
In the Karmelo Anthony murder case, the defense elected jury sentencing, so the jury that convicted him also decided his 35-year prison sentence after hearing from both sides in the punishment phase.
This option has existed in Texas for a long time for most felony cases (except death penalty cases, which have their own rules). Many other states and the federal system leave sentencing only to the judge, which is why it can feel unfamiliar.

Remember the white girl getting stabbed in the neck and dying as blacks walked away getting off the bus. Yeah, white people getting murdered for the sin of being white. Black communities thinking oh well, guess I will go home now. Steps over dying girl. Not my problem.

Am I missing something? Juries do not typically do sentencing, that is the judge's role.

Someone commented down in the thread that since he was 17 at time of crime, that's the max penalty under Texas law.
