They are claiming that they need 2/3 in the Senate to convict and remove from office, but only 50% + 1 to disqualify from future office.
What if they get around 55%?
The counter-argument will be that 50% + 1 was not enough -- still need 2/3. In fact, that point was brought up today.
It will just be another question left unanswered.
I'm under the impression that IF they get the 2/3 to convict then a separate vote for never holding office again is taken, and for that they only need a simple majority....no conviction, no second vote... Source is Ted Cruz who stated this on Crowder's show Wednesday...
I don't know where he came up with the 50%+1 to disqualify. I don't actually think that's true. If that were the case whoever is in the majority can disqualify and opponent that is a threat to win. These clowns think that because they say something that it's law. That asshole should put some shoe polish on the back of his head
Brilliant...his oddly shaped bald spot has been bugging the crap out of me!
pmsl "shoe polish"
They are making up the rules as they go.
Do Senators get an opportunity to question constitutional legality of that or will they simply have a partisan vote on it?
Sen Leahy sounds like he's been sat at the bar all night and couldn't give a fuck what they come up with.
Not awake.
No need to be. His only job is an observer. Staying awake may be optional. Per SCOTUS blog.
I swear they just drag their boddies in and prop them in chairs. The job of all those assistants moving around is to look like they are interacting. He barely looked like he knew what was happening. Sad. Just retire now.
If he is not convicted, how could he be disqualified from office? I didnt hear there were different metrics for that.
I posted about a "different metric" a coupe of times last week. Its called 14A, a simple "censure" by simple 51+ majority, which they will easily have with the 6 GOPe traitors. Chucky dismissed it last week, but seeing how his criminal cabal is failing last I saw he may be ready to enact that.
Where in the constitution does a simple majority bar someone from ever holding office during an impeachment trial?
It doesn't, but they are claiming they can do it. Just throwing it out as a possibility that would throw more chaos into things.
I agree, it would.
