It's unconstitutional, period. The Supreme Court got it wrong. That and gay marriage led me to lose all hope in the Supremes. Clear law, well presented, and they just did whatever they wanted.
Hospitals have long before obamACAre had many rights under law to keep hostages by whatever means possible. If one has the courage to sign out "against medical advice" and one cannot be classed as unable to make this decision (a minor, an elder, a gun owner, a public nuisance, etc.), then one may overcome all the active and passive steps necessary to escape the hostage crisis. This phenomenon was not significantly increased in 2010, what was increased was the many passive and active protocols that can be brought to bear to convince the sovereign citizen to yield sovereignty to the hostage taker.
Individuals in each state should do their homework on state constitution and how it relates to their healthcare rights...who has time to do everyone’s homework for them???
I was thinking about this yesterday and how convenient it is to have Obamacare in place prior to the pandemic. All medical seems to be in lockstep in the US. Not good for the patients. Not good for freedom.
