And technically, it's actually not SCOTUS jurisdiction if the charges are insurrection, rebellion and treason. See the Kavanaugh hearing with Graham's questions. We're not dealing with cases of civil law. SCOTUS has to maintain the show as not to panic the masses once military tribunals start. Populace still needs to be prepared for it.
Any idea why Grahamnesty (RIP Rush) pursued this line of questioning? With hindsight and a Q-centric view, those questions sure sound heavier than they likely would have in my “sleeping” days.
Likely because he knew what was coming. This was a long game. Getting 3 appointments to SCOTUS to ensure that the Court couldn't be used to interfere. At the time of the hearing, this line of questioning was utterly bizarre. I remember watching it live thinking, wtf is he talking about. Although I was also quite impressed with Kavanaugh's ability to recall the cases and correctly answer on the spot... I have to wonder if he was prompted to expect those questions or if he might have even been privy to "the plan"
Then we will have the supreme court twice on record as failing to do their job.
