There are two types of immunity:
Absolute immunity: When absolute immunity applies, a government actor may not be sued for the allegedly wrongful act, even if that person acted maliciously or in bad faith.
Qualified immunity: When qualified immunity applies, the government actor is shielded from liability only if specific conditions are met, as specified in statute or case law.[4]
Both are disregarded if they infringe on the constitution.
Ironically, House passed a bill in 2021 denying police total qualified immunity after George Floyd. It may end up biting them in the ass.
I hadn’t read the judicial watch article, thanks for posting. As usual, it seems the good guys are playing their hand perfectly. The capital police are not subject (have sovereign immunity) to Freedom of Info Act. Makes sense bc giving layout of buildings or other requests could be a security issue. However, judicial watch filed based on common law access. Does the public have a right to access the info? There are two stipulations.
Is it a public record? Defined as documents, emails, videos used to record an action, decision, etc. (IMO, the docs they are requesting fit this stipulation)
Is it in the publics interest? Again, IMO it does as well.
The kicker is that trump fought to have his records kept from the public (knowing he had nothing to hide). This in turn, opened the door to force the release of the J6 capital police records. Again, checkmate

Nancy's arguments that it is not in the public interest was shocking - even though it is getting harder to be shocked by anything they say or do these days.
I wish there was more attention/info on those imprisoned - how many are Patriots and how many Antifa? 13 months so far for some of them - that is in violation of everything this country stands (stood?) for. That is the real Jan 6 issue in my opinion. My belief in the white hats and the plan is the only thing keeping me semi sane regarding the subject.

The head judge is corrupt, and will not allow it to happen.
And BTW ... ALL federal courts are overseen by ONE of the justices on the US Supreme Court. It is supposed to be a check and balance on corruption within the court system. Guess which justice oversees the DC courts?

I’m pretty sure there’s a lot more to WHY they’re being held… it needs some thorough digging. I’m going to go with the assumption ( can make an ass out of me) that it is buried in a statute or bill. Educated guess… the redefinition of terrorism. After 9/11, it became acceptable to spy on on our citizens and more. Today, anyone who disagrees with the narrative or perpetuates “misinformation”, whether it be at a school board meeting, podcast, or peer reviewed study is now considered a terrorist. Holding them without charging them, goes against the essence of our constitution. It doesn’t make sense. But what does in clown world?

If they are still in prison they've been charged. Duck duck go for January 6th sentences or charges. There's a large number of those people who are still in prison because they've been found guilty and are actually serving their sentences. They aren't being held without charge or anything like that.

There is a lot of fog of war but I am not convinced that everyone got due process and had their bails set according to what they would be eventually charged, and that no one was coerced into pleading guilty of something lesser due to the horrific conditions (a standard tactic by DAs to ensure they are not sued for wrongful arrest)
Unfortunately, it has to go through a process. She isn’t out of the woods yet. If (and that’s a big if), they deny the records/videos/emails being released then it will be based on technicalities. I believe the truth will surface, eventually. Patience is a virtue. By the way, I love me a little bit of crazy! It makes life interesting!

Tom threw old Nancy a curve ball on this one by using common law rather than a FOIA request. I would have paid good money to have seen her face when this was dropped in her lap. It will be challenged of course, and in a fair court it should be allowed. But then again, it will be a DC court, so who knows. Anyway, it was a brilliant move and it gives a heads up to others that need to do the same thing. Another good job by JW.
Congress has (pretty much) sovereign immunity to FOIA for national security reasons. They never would’ve won that fight. It’s why no one is ever held accountable
I am just amazed at the numbers of people that are rediscovering legal foundations like common law and implementing them. I do believe this will be key in fighting for our freedom. The powers that be did not dismantle those foundations when they built upon them the legal labyrinth of our legal system that is stacked against us. Utilizing our Sheriffs is another one of those foundations we have yet to fully explore.
I agree. They key is going to be the everyday citizen understanding their constitutional rights and changing the bills/laws that were buried or passed under the guise of something else. This is how we will take our country back from the corruption.
