Just for balance of opposing opinions: It will be interesting to see what exactly Moderna produces as evidence to support their claims. If they venture into this territory, then what the fact checkers are claiming is as usual, BS - even if it is coming from what sounds like plausible rebuttal.

Sounds more like the patent infringement is for mRNA tech used to make the vaccine not the vaccine itself. Let's not read too much into it quite yet.
