Why attack someone for pointing out the truth? Regardless of anyone's feelings about it or the morality of it, the IRS would absolutely consider this a tip even if it was called a gift.
The IRS knows exactly how much sales are credit card vs cash from the restaurant's point of sale. When all of a server's tips come from credit card transactions (which are automatically claimed), they can be red flagged.
The very REASON [they] are pushing for a cashless society is because they cannot track cash transactions on a private level, one of which is cash "tipping" or "gift" in this instance. IRS codes aside, I can tip 100k if I felt like it and IRS cant do jack shit because there's no way to track it and THAT pisses them off.
If that were the case, employees would work for free and their employers could give them "gifts," so their income could not be taxed. The IRS would see things differently.
Man or Woman of Genius. That is awesome.
I second this!! Fantastic idea! Let's all start doing this!
Yes! Cash tips! Also, an alternative to gifting by card, would be to "gift" through one of the left's laundering apps, like PayPal! 😎
I’m guessing it’s a dude since his full name is printed under the signature.
I’m no fan if the IRS, but just because someone writes a note that it’s a gift, doesn’t mean it would actually qualify as a gift to the IRS.
They would 100% view this as income for a service provided if they ever found out about it.
Get fucked.
Sounds like another great reason to disband the IRS

Nobody cares what they think or how they may consider it.
To suggest it matters is a cunt move and will be treated as such by me. Stop caring....it only gives them power.
Even if it was a cash tip, why would you report it?

Not really I have never reported cash tips and nobody I know does either.
If I must use a debit/credit card I always leave a cash tip- I usually pay cash for dining (I'm an old bartender)
We did a declare 10% of cash tips at our bar. I think a lot of places do this.
If you aren't red flagged for something at this point you're doing it wrong.
Bullshit.

If it’s a gift, it’s a gift. Period.

True but would be a good argument. But cash is also hard to track.
