He's already been indicted. "Indicted" means, "A grand jury has decided there is enough evidence to send this case to trial."
On Tuesday, he's being arraigned. "Arraigned" means you have to appear in court to formally hear the charges against you - the charges that the grand jury decided were worth pursuing - and be fingerprinted and mug-shotted.
If they feel like it, you can be arrested and held in jail until the trial. It looks like Trump will be released (probably with monster bail) to return to Florida but I would put nothing past them.
I don't think that this is their gotcha moment. I think that the precedent was set so that the other prosecutors who didn't want to be first to indict a president, don't have that issue anymore. I'm afraid that it might be a first play by the J6 crew (or the GA crew)- for something trivial and some BS misdemeanor that they're trying to turn into a felony by claiming that campaign funds were used. I think that we might be in for a bumpy ride, but it will ultimately blow up in their faces.
He shouldn't have to post bail. NY state law says that any nonviolent felony offender is released on their own recognizance unless they're a flight risk. It should happen that- he's arrested, the judge reads the charges during the arraignment, he pleads not guilty, he's released until his next court date.
Is everyone who is arraigned automatically arrested? I honestly don't know.
That "flight risk" thing is a problem. They could immediately state he's a flight risk for not appearing in court once the trial starts, because he's already living out of state and intends to go back there today. He also has billions of dollars and a jet plane capable of international flight.
I posted this question on another thread. Got some upvotes but no answers, so I'll ask again:
Does anyone know when the all important UNSEAL of this indictment might occur? Not a crystal ball projection, but legally speaking is there a standard time when an indictment is unsealed?
Hoping we have a legal expert on GAW who might know roughly when an indictment gets unsealed or if its entirely random...
I thought he was being indicated on Tuesday.
He is basically saying, imo, that regardless of the arraignment he will be home for dinner (and to address us)
👍👍.
Yeah, I'm confused. But then again, I usually am.

I agree with you. The DS is pushing harder and harder and harder to see what they can get away with. So far, there's been no limit.
Why not hold him there and make some excuse to jail him? Their base would be utterly ecstatic. Who's going to stop them?

Yes, the bail amount will be very interesting. They'll probably try to set it at his total net worth
For a $130k payoff.

They could easily say he's a flight risk.
Makes two of us.
Makes 9 of us.
Here, here
That’ll be over by 2:00. Only a 2 hour flight to FL. Plenty of time…🤔
I thought it was 2:15.
That was the announced arraignment date. He was already indicted.
Correct. Also the unseal of indictment hasn't happened.

When he gets arraigned it will be public or he can go public with the charges at least
Well we are going to find out what happens next.
It won't be any two weeks either.
