How can this be? He is completely under the enlistment contract of the US Military 24/7 and therefore subject to the UCMJ. This is a military issue.

Even as a Guard member not on duty weekend, you can still be tried under the UCMJ if you are an Active Reservist. Coincidentally, Clown members can be charged under th UCMJ as well as Congress critters even though neither of those groups are DOD employees.
Your question is one I'd like to see DOD answer, though. Brings up a very point. How did he access those files if he wasn't on duty, IF he was even the person who accessed and distributed them. I'm wondering if the U.S. Govt is charging him in an attempt to get to whoever did actually gain access.

Wait a sec.... The complaint says "I, the complainant in this case, ... on or about February 28 2023... So, did this happen in February and they sat on it for 1 1/2 months?
If this was a Nat Sec breach why did they sit on it for 1 1/2 months? Why would they sit on it for that long?

National guard guy challenged the CIA guy to prove his credentials
CIA posted the documents, to try and flex. These documents sat in the discord for months.
The documents were discovered, and the government immediately said “it’s Russian disinformation”
Turns out, it was all real.
Anyways, the national guard guy is getting arrested for hosting the discord, and by proxy the leaked documents.
Yes the government arrested the vehicle owner for the drunk guy driving it essentially.

Under 10 USC 802 (3)(A)(ii), it states that all national guardsmen are subject to the purview of the UCMJ whenever they are in federal service status. This is an offense that should be punished under 10 USC 903a article 103a of the UCMJ which states "Any person subject to this chapter who, with intent or reason to believe that it is to be used to the injury of the United States or to the advantage of a foreign nation, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, to any entity described in paragraph (2), either directly or indirectly, anything described in paragraph (3) shall be punished as a court-martial may direct, except that if the accused is found guilty of an offense that directly concerns (A) nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large scale attack, (B) war plans, (C) communications intelligence or cryptographic information, or (D) any other major weapons system or major element of defense strategy, the accused shall be punished by death or such other punishment as a court-martial may direct."

Still need physical access to a SCIF which you can’t just roll up into.
The only thing I can think of is if he was working as a contractor while not on active orders… but if that were the case I’d think that info would be out there.
It makes sense that the last 2.5 years the process has been changed, slapdash ordered allowing this reserve base colllate. The age of this kid is not the issue, if he were on an A Det, he may have helped collect the data. Then it is turned over to the DIA.
