As for "people screw up" there's a difference between a predator who targets toddlers, vs a 13-16yo kid that molests a cousin vs a 21yo horny college guy who knows better but decides to bump uglies with that 16yo jail bait anyway. Also, 16 years old is age of consent in a lot of states so your example doesn't really work there either -- and also falls within most realms of Romeo and Juliet style legislation anyway.

Now, I am also in favor of cruel and unusual punishment for these things so you won't find a ton of sympathy from me -- it's better to strike the fear into the hearts of would-be offenders than to offer provisions that would allow them to feel safe making those "mistakes".
