"Now, Musk has devised a creative proposal that could solve this corrupt “legislating from the bench” once and for all.
His idea centers around elected bodies determining who the absolute worst judges are and having them fired every single year until they are all gone.
“I’d like to propose that the worst 1% of appointed judges, as determined by elected bodies, be fired every year,” Musk wrote Sunday on X.
“This will weed out the most corrupt and least competent,” he added."
Sounds great but it would require a change to the Constitution. You cant legislate this one in. The terms are set in Article III.
We either follow the Constitution or we are no better than they are.
If it was based on decisions that were overturned, you could identify the worst judges based on facts and the DOJ could remove them.
If you relied on elected officials to determine who the worst judges were - well we all know what happens when you rely on elected officials.
I'd go for double digit percentages, but that's just me.
Too bad we couldn't do the same thing with Congresscritters. Maybe let the remaining judges purge the same percentage of Congress...

Judges are not above the law. In fact, in most countries, and states, corruption persists when the judges are corrupt.

Meh. The Constitution was written to protect Judges, even the bad ones, from being fired by "the people". The only way to get rid of a corrupt judge is to impeach him, through Congress. Charges must be brought and the judge has the opportunity to defend himself from those charges. It is a very hard process and only a handful of judges have been impeached throughout the history of this country. The American people have a voice, but it must be through their representatives in Congress, not the ballot box. The US Supreme Court Chief Justice can do something, but I don't know if that action takes the powers away from the wayward judge.
