These don't need to be used for evidence. If the person is showing as nervous or supposedly not telling the truth, the DHS could reassign them to a different position. I'm sure they will investigate those people as well, but the immediate point is to get the leakers our of the area where they have access to that sensitive information.
If those people weren't required to have a poly for their access to classified/sensitive info for their specific jobs, failing this poly should not legally be allowed to be a cause for them being fired - or taken to court. Moving them to another position is not firing them and as long as they keep their same pay grade there isn't anything the employee can do.

These tests are just a part of the show. They know exactly who the leakers are and letting them feel comfortable. Probably to find out who they are working for. I wouldn't be surprised if the leakers all pass the tests to feel like they are good at their job.

That is likely the case plus people are afraid of them. I've had half a dozen plus for hiring and they are stressful. See who resist taking theirs.
