How exactly does this happen? I mean even in the crappiest of liberal states, they typically have to live there uninterrupted for at least 30 days before they get "squatters rights". That's why hotels will often refuse to rent out rooms for more than 20 days (to big a big bigger so there's no doubt) at a time unless it's a penthouse or something where the only people who can afford it are obviously not squatters.
It's one thing when it's a rental property you're not at every day or that you own and manage remotely. It's another entirely when it's your actual house, which again, brings me to the question of how does this happen? Either the cops are idiots (not unlikely) or something else has happened that's not being said here.
You can't prove a negative. If they say they've been there for 30+ days, how do you prove that they haven't? Even if you have cameras with a 100% uninterrupted feed that can be used, you still have to go through the court process to prove it and hope that they take it as infallible proof.
Or you could ask your buddies Smith and Wesson to help solve the problem. That's what SHOULD happen.
