No it cannot be grounds for a mistrial…esp since the trial has not even started. At best it would be possibly used at jury selection to ensure that jurors have not been influenced by this statement. But its likely to not even mater people can state their opinion on guilt or innocence all day long as long they are not doing so in court as a witness.
