Walz and Ellison will use the excuse that they are NOT part of the Minnesota Bureau of Investigation (aka The Bureau of Criminal Apprehension (BCA)) Investigative Services division, nor are they members of the Minnesota Department of Justice. They aren't prosecutors and do not interfere with ongoing criminal investigations in the state.
That said... both Walz and Ellison can simply claim that they believed the BCA or the MDJ was already investigating criminal fraud cases in the state. They knew fraud was happening, but didn't want to interfere with any ongoing law enforcement investigations or make public statements that might affect future prosecutions.
