They won’t go after you for interest if you sent the check itself back. If he cashed it and sent a personal check, he accepted it. You can write void on signature area and mail it back into the IRS and explain why you’re returning it. He can always send in a letter and ask for abatement due to reasonable cause. I used to work for the IRS, anything over 1k in penalties/interest is a write in anyways and takes like 6 months.
The system always sent refunds because businesses took forever to get all the returns in on time and the system would take the extra money, move it and then send a refund if it sat there for a while. (This is the business side, idk about personal side) penalties are different for individual
