We, the People, do not elect the President. The States do, through the Electoral College. Each State has various laws directing the procedure of certifying Electors.
If the laws of a State were not followed in the certification of their Electors, then those Electors and their votes ought to be rejected.
The Vice President, presiding over the Electoral College vote count, has plenary power to define the governing process over the count.
Regardless of what actions Pence could have taken, there could have been only two results - accept and count enough votes to select a President and Vice President, or don't. In the latter case, the Congress would be required to immediately vote to choose the President and Vice President themselves.
The congress could have stalled, but no other business could come before them until they finished their vote. Once the Electoral College is rejected for an election, it's done, and it falls to Congress to choose.
Either Pence is in on the plan, and did his part, or he is not in on the plan, and did what Trump wanted him to do regardless.

A torrent is a group of people on the internet who are sharing a set of one or more files amongst themselves, without "servers". This is "peer-to-peer sharing".
You find torrents using sites like Pirate Bay. Perhaps you want to download a Chemistry textbook. You can search Pirate Bay and find a torrent that (supposedly) contains the textbook you want. You join the torrent by downloading the "torrent file" (or a "magnet" file, same basic concept) with a "torrent client" app.
Your app will use the torrent file to find other people in the torrent, and start asking their torrent apps if they can share the actual files with you. People who are online and sharing the files are "seeding" the torrent.
Once your torrent app finds some seeders, it starts downloading the file(s) of the torrent. You can get different parts of the same files from lots of different users, or if there's just one seeder then perhaps you can get the whole thing from just them. Once you have all of the files for a torrent, your client can become a seeder for that torrent and share with others.
The magic is in how the app finds "seeders". This magic is also where people need to be careful, that they don't dox themselves in relation to a torrent. We can skip the magic bits for this explanation. Suffice it to say, everyone in a torrent can see the IP address of everyone else in the torrent at the same time.
For example, movie companies join movie pirating torrents to gather IP addresses so they can complain to ISPs. If your ISP gets your IP address in a complaint, perhaps you'll get a nasty email, or some ISPs will turn off your service for multiple complaints. You generally, but not necessarily, have to be seeding to "get in trouble".

In this case, the lawyer is correct. If anyone seeks your healthcare information, under HIPAA and other laws, they have to disclose several pieces of information to you as part of the request for information, and they have to provide a healthcare information privacy notice.
Your employer is almost certainly a "covered entity" with regards to HIPAA, as a "business associate" of their insurance company. Even if they are not, they probably need to get you to sign a waiver before they can ask you to disclose any confidential personal or health information, due to privacy laws.
Where most employers are going to get mixed up is in liability for illness in the workplace. If they are taking responsibility for one disease, they are probably exposing themselves to liability to all (or at least, all similar) disease. If they do not accept liability (assume consequences of risk) for, say, COVID, then they have no need for that information. If they do accept liability, well, get a lawyer.
