You don't have to comply, it's personal medical history and you are entitled to your medical privacy. Record the conversation in case they try to fire you for insubordination over it.
HIPAA prevents your employer from asking your doctor for your medical information without your authorization.
It does not prevent them from asking their employees for their medical information.
There are laws that protect some employee medical information from employers. HIPAA is not one of them, And vaccines generally aren't included as protected information.
Well then just tell them to fuck off, and find another job if necessary. A mother fucking company that keeps wanting to get into your business that deep isn't worth a shit to work for anyway.
Don't tell them anything. They can't legally fire you over this, so it will allow you legal recourse if they do fire you because they can't show just cause to fire. If you tell them you haven't been jabbed, they can use the employer non-compliance justification for firing. This was how it was explained to me, so I stopped telling any coworkers whether I'd been jabbed or not.
I work for health insurance.. massive player in Medicaid and Medicare.
They started my surveying and asking vax status. They’ve always encouraged the vaccine, but always states the weren’t requiring it “at this time”…
Then came the request for all to turn in your vax card, with no fax card you must wear a mask at all times and submit to routine testing.. we are still remote at this time, but plan to return in November/December.
Anyways.. last week they officially announced it was a condition of employment unless medical or religious exemption was submitted and approved.
I’m still here.. I haven’t turned anything in or answered any office survey, document or form.
To answer your question - I think it’s going to be up to you to decide what’s best. You know your company, your boss, etc. personally I think none of this is their business, including my religious beliefs.
That’s where I’m at right now. Best of luck friend. Praying for all of us.
My employer wants me to disclose my vax status and sign an agreement to regular rapid testing...
I might be losing my job of 17 years very soon.
Employer has a strict anti-bullying policy but I feel pretty much bullied and under duress to sign the agreement.
I'm not going to sign it.
If you read the Comirnaty vaccine is still under study(clinical trials). The things they are still studying are myocarditis, pericarditis subclinical myocarditis, Pregnancy and Infant Outcomes, immunogenicity. The results of several studies are not due until 2023-2024.
Tell them you will wait till the clinical trials are over to make a informed decision.
My company too. Options to respond: fully vaccinated, not yet fully vaccinated, not vaccinated, or choose to not disclose. My choice, don’t submit the survey at all.
Tell them you are waiting for the approved vaccine. Print off the FDA letter talking about comernarity. They will assume it will be avalible in a few weeks.
Within a month or two, the truth will leak out and this shit will be over.
Approved vaccine will probably never hit the market.
Print this out for them, tell them its a international agreement signed by the United States and tell them to read the part on coercing someone to take a experimental drug.
Tell them in order for you to give "informed consent" you need to know the ingredients of that vaccine. The insert does not list the ingredients. For you to be "informed" you need to know what is in the vaccine.
Tell them the PFIZER-BIONTECH COVID-19 VACCINE is not FDA approved and is still under emergency use authorization and can not be mandated. The version called Comirnaty is what the FDA approved and it is not available till 2023. Here is a article explaining the release date for Comirnaty in the USA.
I know everybody thinks HIPAA applies to employers, but HHS.gov doesn't agree with you.
Who Is Not Required to Follow These Laws
Many organizations that have health information about you do not have to follow these laws.
Examples of organizations that do not have to follow the Privacy and Security Rules include:
Life insurers
Employers
Workers compensation carriers
Most schools and school districts
Many state agencies like child protective service agencies
Most law enforcement agencies
Many municipal offices
I'm not a lawyer, but you will have to decide how much your job is worth to you. I know that many people here will tell you never get the jab no matter what, but not me. The vaccine is a risk, and if you are under 60, much more risk than the virus. But it is still a decision that you have to make. I personally will never accept the jab, but I don't really need my job.
I'm not a lawyer. There are many employers who are insisting on their employees being vaccinated, and I assume they are being guided by their lawyers.
Employers face lawsuits from people that don't want to be vaccinated, but they also face lawsuits from vaccinated that get Covid-19 and will sue their employer for not implementing a vax-only workplace.
So it all comes down to your choice. You can refuse to say and maybe get fired. You can tell them that you will never get the jab and maybe be fired. You can tell them that you will consider getting the vaccine when an FDA approved one is available (which it is not due to the clever little shell game that the FDA played with Pfizer).
Or you can wait and see and only get the jab if they require it and hope for the best. It is your choice. I don't think it is obvious what the right action is. It depends so much how much you like your job.
I've had this bookmarked for reference should it ever be a thing, someone posted it here or on patriots.win at some time fairly recently, and its very good at covering the very many contingencies as to how the conversation with an employer might go.
You don't have to comply, it's personal medical history and you are entitled to your medical privacy. Record the conversation in case they try to fire you for insubordination over it.
I would just tell them I'm uncomfortable with providing my private health info to them. See what they respond with and address at that time.
HIPAA -- that is all they need to know.

If you type resources into the search bar, there are several posts with a lot of info, it will be a good start at least!
can you tell people like employers/doctors that you have had the vaccine without showing them proof or them demanding proof?
You lying would not put you in the best place for a suit either...

I would prepare that they are going to mandate it, and they are surveying now to discover the companies vaccination rate.
Just curious.. how big of a company do you work for? And what industry?

Best of luck in what comes ahead.
