If all this ends up with Twitter crumbling, and if the rumours are true of a $1B cancel fee, then Elon will have destroyed Twitter right after Truth launched and it cost him less than 0.5% of his net worth.
Say what you like about him, but if that is the way it works out, seems like a fairly white hat move.
No matter how a "cancel fee" is written into a contract... if there is FRAUD involved, then the contract is completely null and void.
A contract is not binding if it was signed due to deception. Twitter was intentionally being deceptive about the # of actual users of their site, and therefor the actual value of Twitter as a company.
Exactly! The U.S. Supreme Court has set a loud and clear precedent ruling that "fraud vitiates everything".
That's coming.
He entered into a contract based on false information and value. It is void as we speak. So why should he be punished with a billion dollar fine? That fine will be fought over exposing all the reasons in court why its voided. The pattern has been done and is being repeated. Exposure for twitter.
Not to mention, God can use anyone to advance His purpose.
If I read it correctly, the cancel fee works both ways.
Elon will be PAID $1 billion for his trouble, when all is said and done. Because Twitter will be out of business.
I expect him to sue the executives and directors in their personal capacities for the big payday, which will bankrupt them all.
And let's not leave out the bajillions of law suits inbound to Twatter over false user counts to product waaaaaaaaaaaaaaaaaaaay overpriced advertising costs. That imminent legal liability alone will be enough to nuke this sale.
