The US Government's position is that higher ups are "always working" and can never engage in personal activity. If the judge agrees with that it would mean that government officials can do whatever they want whenever they want, including commit felonies, and they cannot be charged personally. A plaintiff would have to take on the entire US Government to win.
If the judge allows that, we have no law for federal employees. They are free to commit any crimes they want and never be held accountable. That would be a slippery slope the size of a mountain mudslide. It would mean we have a lawless country.
Federal employees in the FBI, DOJ, CIA, etc. clearly believe this idea holds water and I personally think this explains their lawless behavior. It explains their two-tiered Justice system.
A judge that rules in favor of this is basically saying that US Government employees can do whatever they want, especially those in high positions of power.
In my opinion, this would be so catastrophic to our system of law and order that our nation would collapse under this weight.
If the judge looks at the big picture, I do not see how he could side with the government if the judge actually cares about law, order, and our nation's survival.
We shall see.

If they can't be held accountable for their treasonous because they were following orders but the "government" or "United States of America" gave the order then "government" committed the treason and should be punished.

Further, the "government" does not commit crimes...........the employees of said government do and they ALL work for the American people. Even if they commit crimes "in the name of the American people," it's still individuals committing those crimes--those who give the orders and those who implement those orders. I wonder if the people will finally object, en masse, to criminals acting, supposedly, in the name of the people?
Acting for the people but getting paid off by the people who want to destroy our country. To me that is High Crimes including treason

Who is the Judge? Is he a lib or a conservative? Can the Judge ask any justices from the Supreme Court for assistance in interpreting the Westfall Act? If the judge rules the AG was acting within his capacity does this end Trump's case?
Of course, that's their position, because they are trying to get away with their crimes.
But that does not mean they are right.
No government employee has the authority to cross the line from "doing their job" to using the cover of their job to engage in criminal activity.
