Backstory: About three years ago now, my sister was out somewhere with her friend's boyfriend and they hit and killed a guy on the street. He was high as fuck and crossing the street while oncoming traffic had a green in the middle of the night on a street where the speed limit was 55, so his death was ruled his own fault. The problem is, the guy she was with was driving but had 4 wrecks on his record (he was only 23 or something) and his license was suspended so he told her to tell the cops she had been driving and she did, presumably from a combination of shock and wanting to protect her friend.
My parents freaked out when the dead guys family tried to sue for wrongful death and hired a lawyer who told her to change her statement to the police, aka incriminate herself (I'm reporting him to the BAR), and got her arrested on a felony (lying to police) and obstruction. That lawyer took our 5k, got her arrested, and then never answered the phone again. Second lawyer said he would get them to drop the obstruction and bring the lying to police down to a misdemeanor, which makes sense since it's barely even procedural and made no difference in the actual investigation of the incident.
I had assumed that this was pretty much over and done with and had put it out of my mind when I just found out she got a letter to appear in court for her plea. She just got the letter and the court date is for for the 5th of January. Her lawyer didn't get anything and she had to inform him of it; apparently he hasn't been given discovery or half the information he's requested. Despite this, he told her there's "no point" in meeting with him and they'd see each other at court. So I guess instead of postponing it and demanding the necessary legal information, he's planning to just show up and wing it?
The reason I think she's being railroaded is because this happened while BLM was still at a high point and she's white while the guy she was with, the guy they hit, the DA and everyone involved in the case is black with BLM and black advocacy shit all over professional pages. I think they're just trying to extract their pound of flesh from the white girl, possibly even in collusion with the dead guys family since they have no case based on the police report (if she gets found guilty, they could use that in civil court).
Her lawyer is either in on it or unbelievably incompetent because:
- He's been handling this for two fucking years already and still hasn't any negotiations done
- He literally never knows what's going on and finds out feom my sister when she calls him after receiving papers from court
- Despite the fact that the court isn't giving him any info, discovery, or allowong him access, he doesn't think he should do anything about that
- Her plea hearing is on Jan. 5 and she just found out it last week. She had to inform the lawyer about this. Despite sitting on this for almost 3 years, they give her less than a month notice over the Christmas holiday while her lawyer still hasnt received the info he needs.
- Despite not even entering a plea yet, she already received a notification that her jury was selected.
- Neither she nor her lawyer were present for the jury selection or even aware it was happening.
I guess the question is who would I even call about this? Civil rights lawyer for the massive violations of due process? Yet another defense attorney and hope he's not also a fucking retard? My sister was barely 22 when this happened and now she's looking at 10 years in prison and a felony comviction (making all the school she did to be a teacher pointless) because a bunch of fake-woke black bureaucrats want to crucify her over a dead druggie killed by another black delinquent. My parents are prepared to sell their house to keep her out of jail because she'll almost guaranteed kill herself so I really need some advice/reputable lawyer I can call.
One of the things Randy Kelton talks about is the politics of a rigged court. He suggests
*filing bar grievances against your own lawyer if they are screwing things up. Then the lawyer will complain to the judge. A bar grievance can double malpractice insurance, and eventually cause cancellation of it. Some law firms have closed their professional corporations and opened others.
*filing criminal complaints against anyone in the courthouse who commits an act of official oppression (such as denying due process)
*filing criminal complaints against anyone who received a criminal complaint and failed to consider it in compliance with the law
2 years sounds like a denial of the right to a speedy trial. There may be statutes in your state spelling out the maximum standards for each level of offense to be prosecuted. Randy has a caller from California who has been in state court for 7 years for filing a quitclaim deed to himself, which can never be a crime. Randy's advice was to file a federal lawsuit.

The dude is avoiding all contact with anyone and pleading the 5th any time he's caught. I don't think it would change anything anyway since the charge she's facing is lying to the police about who was driving. The actual death of the pedestrian is pretty much an open and shut non-issue outside of the Civil case which is the insurance's problem. If I tried to get a confession out of him, it would probably involve a crow bar so I haven't bothered.

I suspect that she is being "railroaded" because this is in state court. I would coutersue in Federal District Court for all the violations of her Constitutional Rights being done by the state courts and the family and lawyers trying to prosecute. Use 18 USC 241/242 for Civil case and 18 USC 2384 for criminal complaint for constitutional rights violations.
They are likely violating 1st, 2nd, 4th, 5th, 6th, 7th, 8th, and 14th Amendments with restraining orders, asset seizures, and arrest without due process via improper charging. Hit them with civil suit for all expected earnings over her lifetime (likely millions); then hammer them with criminal complaint for violating the Constitution. Has your sister considered claiming that she took the blame under duress? As in the driver made her feel threatened. It may be a lie but she had to be in a hell of a state to take the blame whether dead man’s fought or not.
The only thing I can tell you is that most lawyers suck and are utterly lazy and incompetent. Find the best criminal defense lawyer in your state and hire them immediately.

I'm still learning, but from what I know and from what I've read of your story, there is so much the lawyer should have done that he didn't. My guess is, he dropped the ball and missed deadlines. The prosecutor assigned to this case must feel like they won the lottery. By now they should have contacted your councillor, and I'm assuming they did and your councillor missed many attempts for contact.
Advice: find a paralegal that can point you in the right direction. Most times paralegals do majority of the work for lawyers. They know what's probably been missed, what deadlines she missed and what can be done, who to talk to, and where to get a better lawyer. They can also explain the process of what's going to happen so you're prepared. It's all very expensive but I'm guessing you know that already.
My ex was a prosecutor's aid and he would brag about cases like this. People who don't know the law and don't have anyone who can help them navigate the legal system, are his prey. He's a psychopath and would help fuck with people who had the most disorganized and hopeless cases. They just want to get you off their docket and make it look like they're doing their job.
I'm really sorry about your sister. I really hope she gets off. From what I know, she'll probably get off with something soft but because a death is involved I fear she'll end up in jail for trying to help the guy out. I'm hoping her showing remorse and expressing she will never lie to police again will help her case.
Also I'll add. I'm seeing alot of comments saying to go after the lawyer however filing grievances against your lawyer won't necessarily end up giving you more time or help your case. You'll probably get some dumb lecture about how much time is being wasted and how this isn't the courts problem or how many cases they have to deal with they don't have time to waste, blah blah blah. You need legal advice immediately. You can sue the lawyer later. Focus on her case first.

A few years back I got into some minor legal trouble with an advertising agency.... Long story short I hired someone on www.Upwork.com for legal advice to look into the matter for me and advise me on what to do. Of course I paid him but it was worth it.
What you could do is open a job posting, select a category in legal advice and hire this consultant from the US of course. On Upwork like any freelance networking site you'll be able to talk with them before the actual hire, to see if he or she can help you.
I'm not saying this consultant should show up at court with you and your sister but they can advise you on what direction to take.
What will you do hire some other expensive lawyer and hope for the best? All I'm saying is give it a try and maybe this consultant will be able to help you bypass all the bullshit/ in what proper steps to take.

Some misdemeanor charge or something is one thing. Still unfair given the circumstances and the fact that the statement amendment made zero difference to the overall case, but definitely not the felony conviction and 10 years in prison she's looking at now.

appreciate the reply, it's quite a story/will try to summarize; the person is enrolled in tribe & was accused of a serious crime on the reservation (he maintains innocence/I tend to believe him)
tribal police were first on the scene, and sounds like they were confused/inept, didn't read rights, collect evidence properly, etc. in weeks to follow several officers went into community to tell their ever changing version to hundreds of locals/created much animosity.
then the media got involved, vilified suspect/even encouraged protests, so his trial was a farce & he's now in federal prison/sad situation. hard to sort out 'who' to trust and who'd be qualified with such a case.
I know a fierce tribal law attorney. One who I pray I would never been on opposing sides with. Lord help the person she was prosecuting. She is now a sitting Supreme Court justice for a tribe. Sounds like you have some issues:
Lawyers don’t like malpractice complaints. But making one in these kinds of circumstances aren’t going to suddenly get them to start working. You need a new lawyer that gives a shit. Focus on these charges and this trial. Work on settling scores after that. Reach out to that tribal lawyer I linked you to. At the very least, she could point you in the right direction.

edit to answer a question; it was too much for the tribe/they're keystone cops, so it is at the federal level now. so yes, I wouldn't mind if they moved it somewhere else. think the local media ruined his chances of a fair trial. even non thinking people in the courtroom could see how confused the prosecution was/tried to make everything about race, etc. it was like many of his own 'people' turned against him/lots of liberals on reservation.
