I disagree. The bad guy pointed his gun at everyone and who knows what he said in addition to that. When someone threatens with a gun, they are threatening your life.
The only reason the good waited was so that he could get a clean shot and not get into a rapid fire shootout. If he pulled his gun while he was being directly threatened, meaning the gun was in his face, it would be a fool who would draw while already being aimed upon.
He waited patiently and took out the threat. There is nothing saying the bad guy wouldn't turn around and fire or someone else would do something to make the bad guy fire.
I guess we'll see what the law says in Texas and whether he is arrested for killing an armed assailant.
The argument would be that he was saving the lives of others. The guys was still in there, pointing the gun at others. If he gets prosecuted, Texas is goodbye as a Patriot state.

One has only to fear that their life or those nearby are in danger or that the individual had intent to do great bodily harm. An armed robbery certainly fit that situation.

If you are trained you know why he waited until where he was to shoot the guy. Almost everywhere else there was a chance someone else was harmed.
