The NM thing: governors executive orders don't apply to the general public. If they are actually trying to enforce EOs on citizens that's an overstep, but technically the EO is not unconstitutional since its authority only applies to government positions.
It is the media that is turning this into a political battle on both sides.
I bet if you look closely, you'll find that all covid executive orders were written the same - no enforcement on private property, plus governor has no authority over the public in the first place. It was the media drilling into everyone's heads that mandates were being enforced, virtue signaling, and they went as far as they could with letting people believe it was "the law", but it never technically was.
And the health departments threatening to shut down businesses that didn't enforce it for them as well as things like "oh you're not enforcing masks in your business? And your liquor license is up for renewal in a few months? Shame if that runs into a snag..."
Yup. Shady underhanded tactics. They overstepped by abusing powers of the office to enforce an agenda. They could get away with it for a while because it takes time for people to start filing lawsuits, and the courts weren't friendly to covid dissidents, so it was a shit situation.
