If the recent speculation is true that the Republicans actually lose control of the House due to resignations, then the democrats will immediately charge Trump with "Insurrection" in the house. The house and senate will confirm it being that both will be under democratic rule. They will say, because of the Surpreme Court's recent ruling (were they said it is Congress's job not the states) it is within their rights to do this.
