They do it by US Code Section 26. Using a nebulous definition of "taxable income" which is never explicitly defined. But thanks to the Chevron Deference, the courts were legally bound to accept, without contest, the IRS's definition of what this actually meant.
Things could be very different in the future now that this doctrine has been overturned.
The IRS is a non-governmental agency. A private Delaware corporation operating under color of law. Nearly everywhere they operate is outside their legal jurisdiction.
I heard it's technically based out of Puerto Rico. Can anyone confirm? Does this mean the wordsmiths didn't even have the IRS based out of the US but a territory of it, and we're simply using lawfare and hired guns to enforce it??
So very true! And I can't help but wonder if RFK Jr was connected to those fisherman who challenged the Chevron deference. I have no evidence at all. Just a hunch I have when I think about his support of the fishing industry. He has stated that fishing is one of the industries that America was built on.
I suppose the same way they can, after the statute of limitation has passed (on a misdemeanor), bump it up to a felony, and then proceed to indict and convict a former president without articulating the actual crime, by a non-unanimous jury.
because those people probably hired a lawyer. their loyalty lies with the bar association so if they can get you to confess then you just threw yourself under the bus.
the only thing a lawyer will guarantee is a plea deal. they are not your friends.
e: heres a template i require every lawyer to sign before doing business with them:
FOUNDATIONAL CONTRACT FOR BASIC ETHICS
I, the undersigned, being learned counsel or authorized legal professional, hereby pledge to ___________________________ (hereinafter "Principal") that if and while I am in, or communicating about the possibility of being in, the role of legal service provider, I will:
uphold all of Principal's rights and not knowingly waive any of them vicariously,
be completely honest and tell only the truth,
follow the law and not commit crimes or fraud,
avoid following any policy that violates the law or Principal's rights,
maintain ethical standards and not violate the code of professional conduct, and
make good faith efforts to prevent or mitigate others' lawlessness in this respect.
This contract is not in itself one of legal representation and no representation is inferred. Whether or not we choose to enter into any additional contracts for legal representation, such as are needed to fairly and accurately measure the details of mutual considerations, this foundational contract is, and must remain, the core and primary condition thereof.
Further, pursuant to my duties as an attorney, if I witness any criminal acts by the judge or prosecutor, I swear I will make criminal complaints against them and file judicial conduct complaints or bar grievances as appropriate.
If there’s no law then how can they throw people in prison for tax evasion?

That's a good question… 🤔

Perhaps?
Crazy isn't it...the "system" is not for the people
They are conducting lawfare against President Trump regardless. Same with the taxes. We have been living under tyranny.
