6 Steps to Take after Discovering Fraud
https://www.cftc.gov/LearnAndProtect/AdvisoriesAndArticles/6Steps.html
Number 1 on this list: Don’t pay any more money
I have been told fraud vitiates everything.
Do you think the American people have a case to bring a class action lawsuit against the government and demand return of our taxes?
In the United States, there are laws like the Federal Tort Claims Act (FTCA) which allow you to sue the federal government for certain types of claims, such as negligence.
To sue the government for fraud, you typically need to show:
-
Intentional Misrepresentation: The government entity knowingly made a false representation.
-
Reliance: You relied on that false representation.
-
Damages: You suffered harm as a result.
I think Elon is gathering the evidence needed in this case
Asking for a friend.
I wouldn't risk going to war with the IRS. We know that Trump wants to fix this, but for now, that dog still has some scary teeth.
Now is the time to strike imo. Im not filing and updated my w-4 to exempt. This is war! I can't die knowing I paid taxes to pedophiles.
To my knowledge, no one has ever gone to jail for filing and understating their earnings. Not filing at all is what gets the big hammer. Good luck fren.
Friend of mine hasn’t filed in 7 years, nothing done.
Usually works for no income, self employed, or students.
I suppose if he works and truly owes nothing, the irs is happy to not have to refund him
Has a regular job, has just refused to file again. Fed up like a lot of people.
I have heard that the VAST majority jailed for tax reasons DID file, but fraudulently.
It is best to file with corrected W-2. This is lowest risk.
How to correct your W-2 via form 4852, Adjust W-4, and potentially file amended returns going back 5 Tax Years to get most of payroll tax deductions refunded from the IRS: https://greatawakening.win/p/16aA4T1R4C/success-constitutional-action-ag/c/
i am in the same boat with ya fern and it pisses me off to no end.....they take it every week and then want more while some of these liberal system suckers dont pay a dime but get a 10000 refund...that sucks a big one.. how THE FUK do they get a refund if they didnt pay any to begin with........
Just keep filing for an extension until trump comes through.
still have to pay any estimated owed tax by April 15.

I am in almost the exact same boat and fine myself "owing" a similar amount...I am waiting until April 15th to send payment in...I am still gonna do it...unless stuff changes...I just hope DOGE keeps on DOGEing and we find out we do not have to pay the 2600ish
See posted links in comments. They should help. Correct your W-2, Box1=$0 because it is "labor capital" misclassified as "taxable income". Effective language included in links. I have received all with-held payroll taxes from 2019 Tax Year via check from the IRS after correcting all my W-2s. Made myself EXEMPT on W-4 starting in 2023 Federal and staring in 2024 State.
I need to dig into this. Thank you for that explaination.
This approach works AND is low risk. You are asking the IRS to return money that has been with-held previously in most cases. If you are wrong or the IRS is NOT committing fraud, then all they have to do is say NO, and NOT send you a check. However, they do the opposite and capitulate every time you use that language. What I have done is not theoretical, it is actual AND proven. The four checks they sent to me totalled ~85K (fifth year was EXEMPT on W-4). They are slow walking the ~100K+ refund for payroll taxes for 2018 to 2009 tax years. Only downside is that it can take up to 18 months for them to issue the check as they appear to be either severely backed up or running out of money. But get your request in before the IRS is abolished if you want to get anything back.
The corrected W-2 approach along with 1040-X amended return is clearly the best method that avoids confrontation and having to threaten lawsuits. You also are walking a fine line specifically to avoid contention with your employer. They DO NOT need to do anything, but you technically must send a letter (BE POLITE) to your employer requesting a W-2 correction just to show the IRS that you did something (if challenged; NOTE: They did NOT challenge me on 4 of 4). You can send ONE letter covering multiple years to simplify it, and you can delay it to a convenient time to avoid any retaliation (if needed).
Can we only go back 5 years due to a statute of limitations?
What contention could there be with an employer, ie payroll will want to keep a W-2 instead of 1040 on you?
IRS rules on 5 year limit was made null and void by Chevron Doctrine stikedown by SCOTUS 6-28-2024. I filed 1040-Xs back to 2009 requesting refunds.
IRS could try to make you prove you sent a letter to employer requesting W-2 correction as stated on 4852 on LINE 10. This is why you send it via certified mail to your employer. Theoretically they could ask your employer if you sent the letter, but they (IRS) appear to not be checking before issuing refund check (probably because they do not want to tip off your employer payroll that with-holding payroll tax is 100% fraud from the start, my opinion).
Makes sense. I should try this out.
Perfect dude! This is the way. You're just following the governments own rules now ;-)
Sign me up for that class action lawsuit.
IRS is committing "compelled fraud" by forcing your employer to intentionally misclassify "labor capital" as "taxable income". Use form 4852 to correct your W-2 using this guide:

You need to have all your assets in a Common Law Trust before you even consider litigation against the IRS. They are "more friendly" now than before (and may be gone soon), but a "more friendly" bear can still kill you accidentally. I am nearly done putting all my assets into a Trust, and I will be suing the IRS for fraud shortly for $30M if they do not return all payroll taxes back to the 1980s. They will likely settle in my opinion and give me a check because I am not asking for penalties, interest, and loss of use. I'd rather have my money back ASAP to move it out of fiat before it potentially collapses. Litigation would likely be successful, but will take 2 years.
That might be an acceptable second step, but for the first, you may want to look at some other suggestions first.

My understanding is that “income” has a specific definition, and most of us don’t earn any unless we work for the government or are involved in international trade.
Correct. The "Federal Income Tax" is a voluntary excise tax. If you do not work in a Federal occupation, work on Federal lands, or work in an occupation on the Federal Excise Tax list for Tax Year 2024, then you owe $0 on your labor capital and you can correct your W-2 via form 4852 to show Box1=$0. Your labor capital is being intentionally misclassified as "taxable income" by your employer (under coercion) so the IRS can get a cut of it.
Both your employer and the IRS are engaged in Prima Facie FRAUD, but because your employer is doing it, they are legally liable, not the IRS. You will get nowhere suing your employer, except unemployed, so file form 4852, correct the W-2, send a polite letter to your employer asking for correction (administrative task only), and enjoy the check from the IRS when they send it to you. Yep.
The Internal Revenue Code defines STATE and UNITED STATES in many places.
Petroleum excise taxes have a definition of STATE including the 50 states. Excise taxes on tires and fishing equipment also clearly apply in the 50 states.
Employment taxes include the federal territories, but not the 50 states.
When Alaska and Hawaii became states, ALASKA and HAWAII were removed from the Internal Revenue Code and other federal laws and not placed elsewhere.
The Treasury Department in Treasury Decision 2313 considers a man born in New York to be a nonresident alien with respect to the United States/federal government.
Reader's Digest has a section called Life in These United States. In this case, United States is plural and takes the plural definite article THESE. Think about the meaning when you see the phrase “the United States”.

If the federal government can differentiate between net income tax payers regarding D.O.G.E. possible rebates they should be able to independently address tax money spending. I should be able to vote on my tax dollars being withheld (i.e. stolen) against my will, I should at least have a say how it must me be spent. Reduces redundancies. Block chain the dollars against the government and lock in digital untraceable cash options for the people.

So get this. We were out of work at one point thanks to the COVID scam. When we ran out of savings and COBRA we filed for Medicaid which we were denied so we had to buy insurance from the exchange but because of our sons serious condition we had inadequate coverage that had to be picked up by Medicaid that was later approved on review. You with me so far? Here is the gut punch. The ONE year we didn’t pay taxes since the government forced everyone to shut down so we didn’t have income - that year we were fined under the Obama care gotcha laws. 2800 fine for inadequate health insurance. Payable to the IRS. Sucker punched
