An autopen signature without the president’s direct authorization or presence could undermine the pardon’s legitimacy. For example, if a president were incapacitated or unaware of the autopen’s use, it might raise questions about intent.
So if Joe Biden was not mentally fit coupled with an auto pen signature. The most likely legal outcome would be the pardon not being valid.
And from what I read Obama used it to extend the patriot act while he was in france. So does this get repealed too since obama was "out of the country", or is it a 2-parter where you also have to be mentally impaired like Biden as well?
ThanQ. IMHO, it reminds me of some company sending a mass mail from the CEO with a copied signature. Using this principle with some official document, seems fishy to me.

What exactly is an auto pen? Is it a stamp of a signature, or a digital signature?
It’s mechanical device used since Truman’s time. Obama was the first POTUS to use it for an EO.

This is probably why Trump made a big show of physically signing all his EO's on camera, in front of witnesses.
He's sure shoehorning in a bunch of language that isn't there.
Nothing says no auto-pen other than some dork legal scholar's interpretation.
