The only thing I can think of as to why they would is that they suddenly decided now (and not decades sooner) that the powers Congress gave the Executive branch are an unconstitutional delegation of powers after all.
It’s literally in the constitution plain text that the president has the authority to set tariffs. I don’t see why this has to go to the Supreme Court.
