What is NOT affected
• The ruling does not invalidate all of Trump's tariffs. It specifically targets those relying on IEEPA. Tariffs imposed under other legal authorities remain in place, such as:
—— Section 232 tariffs (national security-based, e.g., on steel and aluminum).
—— Section 301 tariffs (unfair trade practices).
—— Other targeted levies (e.g., on specific products like copper or certain goods).
In practical terms, this decision destroyed his “Liberation Day” tariffs”, and Could now lead to refunds of billions (estimates in the $100–$180+ billion range) in already-collected duties for importers, depending on ongoing processes.
This also sets the precedent that Limits future presidents' ability to use IEEPA for broad tariff policies without new legislation.
". . ., President Trump did have a PLAN B if SCOTUS ruled against him.
The contingency plans include EXPANDED use of Section 232 of the Trade Expansion Act, which allows tariffs on national security grounds and has already been used to target steel, aluminum, autos, copper and lumber.
And guess what SCOTUS did not rule against… Section 232
Read that again… on NATIONAL SECURITY GROUNDS. I mean, everything Trump is dealing with could be classified as National Security Grounds.
Just a guess.. I imagine Trump might post his disappointment about the ruling, and he will go on to say he has no choice but to expand Section 232. Or, expand on other tariff powers yet unnamed.
This is not a surprise for the administration. They have had contingencies game planned from the beginning because they knew the tariffs would be challenged. Many countries under those original tariffs have since made other trade arrangements. So, how many tariffs will have to be refunded we will have to see. Trump and his team know what they are doing and factored all this into their strategy. Meanwhile, the left and their allies will spin the doom and gloom narrative that the sky is falling. We are coming up on the midterms and they don't have much else to run on other than what they create.
Sec. Bessent said during the arguments last fall that they're prepared to reissue the tariffs under the other statutes. They only used the IEEPA because it was the fastest way to stop China's transshipping practices.
Will have to wait and see which tariffs will be affected. Many of those countries that were hit with the Liberation Day tariffs have since renegotiated other trade arrangements with the US and I do not believe those deals fall under the IEPPA any longer. It makes sense now why the Trump administration was pushing countries to come to the table to make a deal. They already had said they were working on other contingencies should such a ruling come down. It is a bit of an inconvenience, but it's not the sky falling.
Reading a little more into this…

They are not "contingencies" if they were the original goal & the original goal was for another purpose.
Is there 4 D chess in The Art of (The Deal) War ?
Could God be one of the D's ?
Well then who the feck can impose tariffs? Only other countries?? WTF Supreme Court
I'm still pissed.
Just so you know , that is not warm rain all over you.

Need to check into their bank accounts ASAP.

yep exactly, trump always said he had other ways to do it,the refund part is what has me befuddled .
It all hinges on the definition of peacetime.
As Trump argued in his first terms: War time President. On top there is a foreign funded insurgency in 2020, a stolen election .....
I am not so sure that this is the end of the matter ...
DOGE has to dig up a lot of sacred cows to cover the loss. Ah well.
